V. SALE OF GOODS
The sale of goods through the Store is governed by the Terms and Conditions.
1. The prices of goods are displayed in Polish zloty (PLN), euros (EUR) or US dollars (USD) and are inclusive of VAT. Prices do not include delivery costs, which are set out in the Shipping tab, which forms an integral part of the Terms and Conditions.
2. All products offered in the Store are new and free from physical and legal defects.
3. The colour or shade of goods may slightly differ from the images displayed in the Store due to the display settings of the User's device.
4. Orders are accepted via the order form on the Store's website upon clicking the button "I confirm the order with obligation to pay" or equivalent. Where the person placing an order is not of legal age but is over 13 years of age, the order must be confirmed by a legal guardian.
5. Orders may be placed 24 hours a day, 7 days a week, subject to technical interruptions and failures.
6. Orders placed on business days after 11:00 AM, on Saturdays, Sundays and public holidays are processed on the next business day.
7. To fulfil an order, the Customer must provide a delivery address (first name and surname, street, postcode, city) and contact details (telephone number, e-mail address).
8. If incomplete or incorrect data is received, the ADMINISTRATOR will attempt to contact the User to obtain the missing or corrected information. If contact proves impossible, the order will not be fulfilled.
9. After placing an order, the User will receive an automatically generated order confirmation e-mail at the address provided.
10. Goods are delivered via courier companies or Polish Post, at the User's choice. Upon receipt of a courier delivery, the Customer is advised to inspect the parcel for any damage. If damage is found, it is recommended to draw up a damage report in the presence of the courier and to notify the ADMINISTRATOR without delay. Failure to do so does not affect the Customer's right to make a complaint.
11. Delivery times depend on the chosen delivery method and are indicated on the Store's website.
12. The dispatch time shown for each product indicates the period from the placement of the order to the shipment of the parcel from the ADMINISTRATOR's premises (business days only).
13. Where an order includes products with different dispatch times, the order is fulfilled once all items have been assembled, i.e. after the longest indicated dispatch time has elapsed.
14. The estimated delivery date represents the total order fulfilment time plus the carrier's estimated delivery time.
15. Domestic delivery costs are set out in the Shipping tab.
16. If any goods included in an order are unavailable, the ADMINISTRATOR will promptly inform the Customer. A Customer who is a Consumer or Consumer-Entrepreneur will then have the right to: cancel the entire order, cancel only the unavailable item, agree to an extended fulfilment time, request partial fulfilment of the order, or agree to a substitution of the unavailable item with a similar product of comparable properties and price.
17. Available payment methods:

18. A Consumer or Consumer-Entrepreneur may withdraw from the sales agreement within 14 days of receiving the goods without giving any reason, subject to paragraph 22 below. Withdrawal is effected by submitting a written statement sent to the ADMINISTRATOR's address or by e-mail. The withdrawal form may be downloaded here. To meet the deadline, it is sufficient to send the statement before its expiry.
19. Refunds are made: for payments by bank transfer – to the account from which the payment was made; for cash on delivery payments – to the bank account number provided in the withdrawal statement.
20. The Consumer or Consumer-Entrepreneur must return the Goods without delay, and no later than 14 days from the date of withdrawal.
21. Upon effective withdrawal from the agreement, the ADMINISTRATOR shall refund all payments received, including the cost of delivering the Goods (up to the amount of the cheapest standard delivery option available in the Store), without delay and no later than 14 days from receipt of the withdrawal statement. The ADMINISTRATOR may withhold the refund until the Goods have been received back or until the Customer has provided proof of return, whichever occurs first.
22. The right of withdrawal does not apply to contracts referred to in Article 38 of the Polish Consumer Rights Act of 30 May 2014, in particular to Made-to-Order Products, i.e. non-prefabricated items produced to the Customer's specifications or clearly personalised to meet the Customer's individual needs — this applies in particular to made-to-measure and custom-made products (Article 38(3) of the aforementioned Act). This exclusion does not affect the Customer's right to make a complaint on grounds of non-conformity of the Goods with the agreement.
23. The cost of returning the Goods to the ADMINISTRATOR is borne by the Customer. The Consumer or Consumer-Entrepreneur is liable for any diminution in the value of the Goods resulting from handling them in a way that goes beyond what is necessary to establish their nature, characteristics and functioning.
24. The ADMINISTRATOR is liable to Consumers and Consumer-Entrepreneurs for any lack of conformity of the Goods with the agreement, in accordance with the provisions of the Polish Consumer Rights Act. This liability applies for a period of 2 years from the date of delivery of the Goods.
25. If the Goods are not in conformity with the agreement, the Customer may request repair or replacement. Where repair or replacement is impossible or would entail disproportionate costs, the Customer may request a price reduction or withdraw from the agreement, in cases provided for by law.
26. In respect of Customers who are neither Consumers nor Consumer-Entrepreneurs, the ADMINISTRATOR's liability under the statutory warranty for defects (rękojmia) is excluded to the fullest extent permitted by law pursuant to Article 558 § 1 of the Polish Civil Code.
27. A sales receipt is issued for every item sold. A VAT invoice is issued upon request.
28. If the ADMINISTRATOR does not uphold a complaint, the Consumer may use out-of-court dispute resolution mechanisms, including the Municipal Consumer Ombudsman, the Trade Inspection Authority or the Consumer Arbitration Court. Detailed information is available at www.uokik.gov.pl under "Consumer dispute resolution". These mechanisms are not available to Consumer-Entrepreneurs.
29. The Seller declares that it does not consent to the resolution of consumer disputes under the Polish Act of 23 September 2016 on out-of-court resolution of consumer disputes (Journal of Laws 2016, item 1823).
